The FDA Law Blog has some good information about a pending ruling concerning a New York City regulation requiring restaurants to post calories counts on their menus and signboards. This could have a wide-ranging impact on the restaurant industry. I’m not a lawyer by any means (although my wife says I do like to argue
), but it seems to be an interesting case. Does a federal law from the early 1990s supercede a current statute? What constitutes disclosure? I, for one, hope that New York City wins this case. More disclosure is better. Now we know what Chipotle was talking about when they cited pending litigation as a reason for not providing nutritional information.
